05.08.06

Just heard back from the ADA with an update. She's finally worked her way through all of my case evidence. She is proceeding with the recommendation for certification as adults. And filing the assult charge on the driver. I asked her if there were any issues because I know for a fact that I had a shoe mix-up when giving my statement. She told me not to worry about it, that everything was working out just fine. At the earliest they will have the DNA back in 4-6 weeks, but even then she'd be surprised. By the time this goes to trial though, they will have everything they need.

So essentially this week she will get the recommendation for certification together, she gets her boss to sign off on it, and then the person that oversees sending the certification to the grand jury to sign off on it, and within 2 weeks, the certification will occur.

Once they are certified as adults, they will be offered a bond, which they are not offered as juveniles. She's already told me that due to the severity of the crime, she will be asking for a very high bond, and that most judges would agree to that. And there is little to no chance that the two of them will be able to afford to bond out. So it kind of sucks that they even get the chance to bond out, but that's the price to pay to have them tried as adults.

And there is also a chance that she will follow this case all the way through to adult court as well. It depends on how busy the juvenile docets look for the summer. If there is room in the case load to where she could still work on my case, she's going to keep it if possible. Which makes me feel good. The less shuffling the better.
